Terms of trade
These terms cover the measure-and-design visit sold through this website. A renovation is done under a separate written contract, and these terms describe what that contract will contain.
1. Who you are dealing with
Bathroom Renovation NZ is a trading name of Kauri Ridge Holdings Limited, NZBN 9429050000017 (“we”, “us”). Bathroom Renovation NZ is a trading name and the operator of this website. Contact: hello@bathroom-renovation.co.nz. Address: Level 1, 12 Kōwhai Lane, Grey Lynn, Auckland 1021.
We are the contracting party and the project manager for a renovation. We are not a plumbing company, not an electrical company and not a Licensed Building Practitioner. Sanitary plumbing is carried out by a person authorised under the Plumbers, Gasfitters, and Drainlayers Act 2006, prescribed electrical work by a registered electrical worker, and restricted building work by a Licensed Building Practitioner. Those subcontractors are named in your contract with their registration details.
2. The measure-and-design visit
The visit costs $395 including GST. It is a paid service, not a deposit, and it does not reserve a build slot or commit either of us to a renovation.
What you get for it:
- An on-site visit of approximately 60 to 75 minutes, at a time we confirm with you by email.
- Measurements of the room and its fixtures, photographs, non-invasive moisture readings around the shower and bath, an inspection of the subfloor from below where there is safe access, and a check of the fixtures, waste positions and extractor fan.
- Within 5 working days of the visit: a scaled plan of the room as it is and as proposed, a line-item budget range, a building consent assessment identifying the relevant Schedule 1 clause or explaining why consent is required, an asbestos flag and testing route for homes built before 2000, and a written scope naming the trades that would do restricted work.
The documents are yours to keep and to use, including with another company. The budget is a range built from published cost bands and our assessment of your room, and is not a fixed-price quote.
3. Confirming a visit
You give us up to three preferred windows. We confirm one by email within 1 working day of payment. No visit is booked until you have that confirmation email. If none of your windows works we will offer alternatives.
4. Refunds and the credit
You get a full refund of the $395 if:
- you cancel more than 24 hours before the confirmed visit time; or
- we cannot offer you a visit within 10 working days of your payment; or
- we do not deliver the plan, budget and consent assessment within 5 working days of the visit.
Once those documents have been delivered, the fee is not refundable, because you have received the service. It remains credited in full against a renovation contract signed with us within 6 months of the visit. The credit is applied to the first contract payment. It is not transferable to another person or property and it is not redeemable for cash.
Refunds go back to the card used. Stripe's processing fee is not returned to us on a refund; we absorb that and do not deduct it from your refund.
5. Access and safety
You need to give us safe access to the bathroom and, where relevant, to the subfloor. Please clear the floor and the vanity beforehand. We will not enter a subfloor or roof space we judge unsafe, and the plan will say so where that limits what we could see. If we cannot get access at the confirmed time and you have not told us at least 24 hours beforehand, we may charge the visit as delivered.
6. A renovation contract
These are the terms your contract will contain. The contract itself prevails over this page.
- Fixed price against a written scope, produced from the visit.
- Payment schedule: 20% on signing less your visit credit; 35% on completion of strip-out, framing repairs and plumbing rough-in; 35% on completion of the waterproof membrane (photographed) and tiling; 10% on completion, released with the records pack.
- Variations: anything found once the linings are off is quoted and agreed by you in writing before it is carried out. Nothing is added to an invoice without your agreement.
- Records packon completion: dated photographs of the substrate and each membrane coat, the membrane product data sheet and installation instructions, the plumber's details and any certificate issued, the electrician's certificate of compliance, and the extractor fan specification.
- Defect repair period: 12 months from completion, in addition to your statutory rights.
- Disclosure statement and consumer checklist: provided before you sign, on every job.
7. Consent
Our consent assessment is our professional opinion based on the Building Act and the work as scoped. It is not a determination and it does not bind your council. Where we consider consent is required, obtaining it is dealt with in the contract. Where we consider the work is exempt, that opinion is stated with the Schedule 1 clause it relies on, and exempt work must still comply with the Building Code.
8. Asbestos
We do not test for or remove asbestos. Where a home was built before 1 January 2000 we will identify what should be tested before a strip-out and will not begin one until testing has been carried out by an appropriate contractor and any removal has been completed. Testing and removal are not included in any price on this website.
9. Your rights under New Zealand law
Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where you are a consumer. Our services must be carried out with reasonable care and skill, be fit for purpose and be completed within a reasonable time.
For residential building work, the implied warranties in the Building Act 2004 apply and cannot be contracted out of. Because we are the contracting party, those warranties sit with us.
If you are acquiring our services in trade, sections 9, 12A and 13 of the Fair Trading Act and the Consumer Guarantees Act do not apply, to the extent the law permits that agreement.
10. Liability
Other than the guarantees and warranties described above, and to the extent the law allows, our liability for the measure-and-design visit is limited to re-performing the service or refunding the fee. Liability under a renovation contract is dealt with in that contract.
The budget calculator and the cost pages on this website are general information built from published third-party cost bands. They are not a quote, not an offer, and not professional advice about your property.
11. Prices and GST
Our own prices are shown in New Zealand dollars including GST. Published cost bands from third parties are shown with the GST status that source states; where a source does not state one, the page says so. We may change prices at any time, but not after you have paid for a visit.
12. Payments
Card payments are processed by Stripe on Stripe's own hosted checkout. We do not receive or store your card details. Contract milestone payments may be made by bank transfer.
13. Privacy
We handle your information as described in our privacy policy.
14. Changes and law
We may update these terms. The terms that apply to you are the ones published when you paid. These terms are governed by New Zealand law and the New Zealand courts have jurisdiction.
15. Complaints
Email us and we will respond within 1 working day. If we cannot resolve it between us, the Disputes Tribunal is available for claims within its limits, and a determination from the Ministry of Business, Innovation and Employment is available for certain building disputes.
